Since I left the apartment in better shape then when I moved in I was stunned so a lawyer-friend for advise. She suggested I file a small claim suit after my landlord for failing to return my deposit. That served to require the landlord to face me in court without me accruing legal expenses. Luckily, I had before and after photos of the apartment because the apartment had horrible stained carpet and a friend whose husband owned a small business selling carpet remnants. He sold me a cheap carpet remnant that was just taking up space at his shop and friends helped him install it in the apartment before I moved in. The landlord owned dozens of building so there wasn't around. I took the photos because I was actually worried about "improving' the apartment.
The landlord tried to get me to drop the case by getting it continued over and over but it started to become a matter of principle. I wondered how many other people didn't get their deposit back and since I worked near the court house and had a flexible schedule, I just showed up every time.
When the case was finally heard, the landlord wasn't there, he was represented by an attorney and not a very compete one! He arrived not even knowing what the case was about so the judge asked me to start. I was super nervous but I followed the advice given to me at the information booth - be simple and direct. I stated the facts of the case and that I had before and after photos of the apartment. The judge took one look at the photos and told the lawyer he would set a court date unless I had received a refund of my deposit within 14 days! A small victory for the little guy.
