"The attorney currently is retained only by me" - Not likely. Lawyers take retainers from many clients, not just one. Otherwise you would be paying his entire salary.

I don't see any reason to ask him to not take on the other client.

You can use either a "no win-no fee" lawyer, they however will take a cut of your award. Or you can use a lawyer and pay fees, that will likely cost you about the same when all is said and done.
