If she is filing a no fault divorce (a divorce that usually means irreconcilable differences) NY state requires you to be legally separated for 1 year BEFORE you can even file for divorce. Once the year is up you can file.
If its an uncontested divorce, meaning you two agree on the terms of the divorce, a lawyer is not required. If you two cannot agree on the terms, then its considered contested and will require a lawyer.

I Want To Have My Husband Removed From The Birth Certificate, And Have No Obligations In Regards To Child Support, And Then Proceed With The Divorce Proceedings. I Don'T Know Where To Start And I'Ve Contacted Various Agencies To Find Out And I Keep Getting The Runaround. Do I Establish Paternity First? Or File For Divorce First? If The Baby'S Biological Father Won'T Submit To A Paternity Test, What Are My Options?? It'S A Big Mess, I Know. But My Husband And I Weren'T Together When I Conceived With My Ex-Boyfriend. Now, The Ex-Bf Is Saying He Won'T Have To Pay Child Support Because He'S Not On The Birth Certificate And He Isn'T Responsible For Anything To Do With Our Son! There are simular states where the husband would legally be considered the father. I know this happened to me, when I filed for divorce he tried for full custody and I told my attorney he was not the father but it did not matter. Ultimatly my ex signed over his parental rights and my new husband (13 years) adopted my son.
What you need to do is file for divorce, go file for child support and name your ex boyfriend on the papers in family court. He willl have to do one of two things. Either he will submit to paternity to prove he is or isnt' the father. Or if he does not show up, the judge will order a default order.
The hospital I believe was wrong legally you could name anyone to be on the birth certificate Hell you could have name Brad Pitt.
Being on the birth certificate does NOT make you the father, it's just a piece of paper it's what we like to call putive father.
You need to contact the vital satisics office there in your state tell them you were forced to place someone else on the BC and you want to new one issued.
