What Is The Role Of The Legal Adviser In The Magistrates Court?

Magistrates are normal people not solicitors so wont know the legalities of any orders or legal implications of past cases which may have set a president in law.

The legal adviser would let them Magistrates know if there are any presidents or facts of law they need to be aware of.

An example would be if they wanted to give out a fine more than the maximum penalty set/allowed, a legal adviser would advise the magistrates what he can fine the defendant.

If the defendant said he could not afford to pay the fine and the magistrate told the defendant to get a loan.

A legal adviser would correct him and point out he cant order anyone to get into debt.

This is to avoid presidents being set and mistakes made which could further lengthen court cases if they have grounds to appeal a decision.

A Magistrate would seek advice from the legal advisor if he was unclear on any matter.

Getting Into Law School?
I Need Some Tips On Getting In! What Is A Good Major? What Is A Good Score On The Lsat'S? What Is The Best Gpa That I Should Not Go Below. I Could Really Use Some Advice Of The &Quot;Been There Done That&Quot; Sort.

I want to echo some of the comments made by the person above me. Your major doesn't really matter. A very challenging major (like math or science) might give you an edge if you're already competitive at a school and certain majors like so-called "pre-law" or criminal justice are usually considered undesirable.

A perfect LSAT score is 180. The test is curved, so how many questions you can miss and still get a 180 varies by each examination, but usually 1 to 3 questions. As for what constitutes a good score, that really depends on the law schools you want to attend. For the top 14 schools, you would ideally have a 98-99th percentile LSAT score (170-ish+). For top 50, a 165+ is really helpful. As for GPA, that varies by schools, too. I would like to disagree with the person above me on this point: you can have below a 4.0 and get into Yale, Harvard or Stanford Law. It gets exponentially harder below a 3.8, yes, and a 4.0 certain helps, but these schools often take people in the 3.8 range and Harvard has accepted people as low as 3.6, but it's uncommon. For really any other law school, a 3.5-3.6 is fine, but what you'll need on the LSAT score will change. Some schools in the top 14 do take people with GPAs around 3.0 or even lower, but they all have high LSAT scores to balance it out.

To keep your options open, try not to let your GPA slip below 3.5. You can still get into an amazing school, but some schools will just be closed off you to below that point. As for your LSAT, aim as high as possible, of course, but a 170+ score can get you into some fine schools.

If In A Accident With Someone Who Has The Same Insurance Should You Hire A Lawyer?

Same insurance company has nothing to do with it.

Keep in mind that hiring a lawyer will typically cost you 1/3 of any recovery if on contingency, or thousands if paying cash up front. Very few accidents require a lawyer, unless you are really, really unhappy with the insurance adjuster's settlement, suffered serious bodily injury or feel that you are being grossly shorted in a way that would merit incurring the steep legal costs.

If an accident is all it was - just negotiate with the insurance adjusters yourself. Even if you are a few hundred bucks unhappy, it won't be worth a lawyer.

How Much To Pay For A Divorce Attorney?
How Much Should I Expect To Pay For A Good And Experienced Divorce Attorney In Indiana ?

That will vary depending on where you live, what your circumstances are, and how big a fight you are going to have. If you have been married for a long time, have children and property, have retirement funds and inheritances, etc. the bill is much higher than if you have only been married for a couple of years and hae no children or property. If also gets more expensive if the divorce is contested by one party, as opposed to both parties agreeing to the divorce and the division of property.
If there is going to be a battle, usually it pays to spend extra money up front and get a good attorney who will more likely get you a better settlement. Spending a little more up front can save you a fortune in the long run.

3Rd Degree Assault Charges?
My Brother Got Assault The Other Day And The Person Who Attacked Him Is A Minor, 15 Years Old, And I Want Any Advice Possible In How To Handle The Situation. The Boy Was Taken In By The Police But Released The Same Day. I Live In Nyc. Any Help? We Pressed Charges But The Police Have Not Responded To Us And Its Aggrivating.

First off he is a minor and that is something you have to think about. I would give this at least a week before you tried to handle it. That way it gives the clerks time to file anything that needs to be filed. As far as the degree goes I am unable to handle that because I really dont know what a 3rd degree assault is.

If its something bad then file a lawsuite and hit the parents up for any bills that you have aquired via time off from work and what not.

Side not, did he do anything to your brother ie hes 15? Im 31 so more than likely I would just let it drop because hes just a kid and im a man and well, i can take a punch and have my ego bruised from it np.

UPDATE

This is your brother and the only person that would be filling is your brother. Now you can go with him and help him file the paper work but thats about it. Your not the victum thus your unable to do anything about what happened. The bad thing is that he is 15 and a lawyer is going to use that to dum down the case. Now if your brother is 135 pounds and this 15 year is 7ft 325 pounds then yes I would file.

The best thing you can do is have your brother talk to the police about it. Most of the time I see guys get in fights they then spend the night in the tank. If its a bad fight it could be a couple of nights and then your off to get a court date with the judge.

Side note, anything that upgrades his fist to a felony is somehting you should look into. Assault is one thing but if the person is a black belt in Karate then you have a whole new issue on your hands.
