Child Custody Case Wasn'T Fair Yesterday?
Yesterday I Had A Court Case Involving My Daughter 10 And Son 8. 2 Days Before Christmas Of Last Year I Allowed My Children To Go Spend Time With Thier Grandmother And Father For The First Time In 8Yrs. They Where Never In The Kids Life Before Then. The Agreement Was That We Exchanged The Kids After New Years But When I Called Her To See When We Gonna Make The Exchange And Where We Was Gonna Meet And Also Asked Her To Send Her Address To My Phone The Grandmother Stopped Answering The Phone She Also Wasn'T Answering My Text Messages Anymore. I Found Out She Went Behind My Back And Filed For Custody With No Visitation Rights. I Then Went To The Address Thay Was On The Paper That The Grandmother Provided To Get My Children With Greenville N.C Police And They Told Me They Couldn'T Get Involved In Child Custody. So I Had To Wait For Court. Yesterday Custody Was Giving To The Grandmother Because I Didn'T Have A Lawyer The Judge Said I Didn'T Bring Enough Evidence. What Can I Do Now???
Okay, where to begin?
1) When children are born, *legally* the mother and father have equal rights.
2) When custody has not been established in court, the parents do not live together and are not married, and the case is brought to court: It is up to the parent who does NOT have physical custody (ie: the children living under their roof at that moment) to prove the other parent is unfit. What does that mean? It means that if your kids stayed at their house last night, YOU have to PROVE he's a bad dad, or it's a bad home, or a history of abuse, or that he can't support them.
And no, your word against his doesn't count as proof.
Legally, it's fair. The judge did what the law says he must. The police really can't get involved in custody disputes, and especially not based on your word. Morally... eh.
First and foremost, you need legal cousel. If you can't afford a lawyer, call 211 from your home phone, and they can tell you exactly who to call for help with that.
Beyond legal counsel... Proof is what you must have, or even the best lawyer in the world won't be able to help you.
What counts as proof? Well, if they've really lived with you, and only you, for 8 years, then you have lots of proof of his *neglect* and possible *abandonment*... Things like school and medical records, proving the children lived with you and you alone. Any prior settlements/agreements, either from court or in writing.
As for proving you didn't intend for the children to live with him... Unless you have something in writing, it will be a tough case.
1) You never, in 8? 10? years, thought to file for custody.
2) You sent your children to stay for months with a virtual stranger (relative or not).
3) You (apparantly) didn't get any kind of written record (including a temporary guardianship agreement allowing the children to be treated, medically, without you present)
4) You showed up in court without a lawyer, as if it were a minor thing like a traffic ticket.
Now, I'm not trying to judge you, but, honestly, this is what the JUDGE is going to be looking at, and I want you to know what you're up against. And it doesn't look good.
The ONLY thing you have going for you is the fact that he hasn't been in their lives. And even that is hard to prove. Once you prove they've lived with you, you still have to show that he hasn't been sharing summers, or overnight visits, and that you didn't just *send the kids to live with him* and then change your mind.
And if/when you prove that he is an unfit parent, you still have to prove to the judge that you can provide a stable home for them. Considering that 1-4 above will still be on his mind, that might be difficult.
Believe it or not, birthing/housing children (no matter how long) doesn't give you as many LEGAL rights as you think.
And only a lawyer can address all the OTHER hidden points of law not listed here.
In short? As the answer before me stated, get a lawyer. Which you should have done before it came to this. Otherwise, you won't get your kids back.
