New York State Working Laws?

Should I Have My Own Attorney Present For An Examination Under Oath For A Insurance Claim?
My Car Was Stolen & State Farm Has Already Questioned Me & Now They Want Be To Do An Examination Under Oath.
An examination under oath is a right that an insurance company has to ask you questions about a loss. The EUO is usually performed by an attorney hired by an insurance company. The EUO is recorded by a stenogrpaher who will first swear you in and then make a transcript of your statement.
Some people take the attitude that if you have nothing to hide, there is no reason to bring an attorney to the EUO. I would not agree with this concept, even if you don't have anything to hide. Since there is no one else in the room, there is no one to protect your rights or to tell the attorney that he has stepped over the line. For example, if the attorney were to ask a question that touched on wholly inapprorpiate subject matter or if she asked a question that was improperly phrased (something like - do you still beat your mother - a yes or no question that can't be answered with a yes or no) - you would not know how to act.
Another reason to take an attorney is that you may not even know that an area is problematic to you. I have seen many cases where people were (unwittingly) committing policy violations that were exposed at an EUO. Your attorney will know what to ask you before the EUO and to prepare you to answer questions that may be asked.
The EUO is a very powerful tool in the insurance carrier arsenal. When used properly it can prevent insurance carriers from paying claims they should not be required to pay. When used improperly, it can lead to nightmares for the insured where they are interrogated about irrelevant issues before having their claim denied on completely bogus grounds. If this happens, you will then need to hire an attorney anyway to go to court and force State Farm to pay the claim.
Bottom line - State Farm has a well earned reputation for being aggressive with their EUO practices. Even if you don't believe that you have done anything wrong, you should still talk to a lawyer and consider bringing one to the EUO.
On Average Do Criminal Or Civil Litigation Attorneys Make More Annually?
I am only guessing here, but I would say civil attorneys make more money.
Civil law has several sub-categories. Some attorneys go into corporate law. Some work as defense attorneys, which means they are mostly working for insurance companies. Some work as plaintiff attorneys. Some specialize in product liability, or medical malpractice, or transportation, or construction, or auto claims. And then there is family law, the robber barons of the business.
About 5 years after my sister’s divorce was final, she was served with a post trial motion. It was a motion seeking a reduction in spousal maintenance. She hired an attorney to handle this motion for her. This brief period of representation lasted less than 4 months from beginning to end. Her attorney charged her $47,000, which is outrageous for 4 months of representation on a fairly routine motion.
My sister objected to this outrageous legal bill, and in accordance with the terms of the retainer agreement, she filed in arbitration seeking a reduction. My sister represented herself. Her attorney hired an attorney to represent her. In analyzing the legal bill, for example, we found 27 strategy conferences, in which her attorney had meetings with other attorneys in the firm all to discuss “strategy” on this very routine motion. And then each attorney participating in the strategy conference would charge for their time. There was obviously tons of unnecessary legal work being done. We even found mathematical errors in the legal bills where they simply added wrong. My sister spent many hours analyzing and preparing her case for arbitration, and she had many valid arguments to make. Even the judge had commented in the final judgment legal memorandum regarding the excessive legal charges, and this was submitted in the arbitration hearing as well.
The arbitrator appointed happens to be --- you guessed it, another attorney. The arbitrator was allegedly, an “independent” attorney, but we all know they come from the same club. The arbitration hearing lasted 8 hours. The final decision was that the legal bill was reduced by ZERO. They did not even reduce the amount of the bill for the mathematical errors.
So my sister had to pay the entire $47,000. And she did pay it. But how OUTRAGEOUS is that?
I Pay Child Support But She Took Off With The Kids And Disappeared?
Child Support Comes Out Automatically Every Month, But She Took Off With The Kids And Not Allowed Me Visitation For Almost A Year. I Have Been Trying To Find Her But Have No Luck I Have Gone To The Courts To Stop The Order But They Keep Denying Me. I Have Also Tried Going Thru Cse And Explained To Them They Are Basically Helping Her Be A Fugative. Is There A Way I Can Get Records From Her Cse Card To Show Where She May Be So I Can Take Her Back To Court?
Child support enforcement has a child locator service under federal law. Use it, and also file for contempt of court for denial of access. If she does not show up, she is held in contempt, which is grounds to immediate change of custody. You do not even need an attorney.
As for child support, you are asking the wrong question. You want it frozen, not stopped. You still pay, but the state holds onto the money until she appears.

What Do They Ask You During An Examination For Discovery In A Personal; Injury Case?
I Am A Brain Injury Victim From A Car Accident,And Will Be Examined By The Defense Lawyer. What Will I Be Asked?
This is not legal advice. If you require legal advice or representation, consult an attorney licensed in your jurisdiction.
It sounds like you are describing what is known as a deposition. A deposition is an out-of-court opportunity to depose/examine/ask questions of a party or witness in a case. The rules in a deposition are nothing like Law & Order. It's very informal and the attorneys will object to things like the "form of the question" and whether the question has been "asked and answered", but there is no judge present to rule. The attorneys are merely recording their objections for the record, and you will still answer the questions.
Depositions are taken under oath, and you can be asked about nearly anything. There is no reason to be nervous, and your attorney will be present to protect your rights should the defense attorney become overzealous. Most of the questions will be very routine, about your identity, education, marital status, and background. Then they'll ask you about the accident most likely, and finally they'll ask about your medical treatment and your quality of life since the accident.
Don't worry and don't panic. You just have to answer simple direct questions truthfully. Afterwards, it'll be funny that you were worried about it at all.
Of course, if your attorney tells you anything, listen to him. If anything he says conflicts with anything I say, listen to him.
