The "Grandparents Law" is like an Urban Legend. It has about as much pull as Big Foot or the Lochness Monster. Grandparents just can't take someone's kids away because the woman (or man) left their child. If that was possible--how many people would still have their children?

P.S. I do love grand parents and in some cases they defiantely need to step in and help families. The grandparents law often pertains to visitation rights--not gaining custody of a child when the parents are able citizens. But in this scenario this is a scare tactic and it's load of bologna.

Don't worry about it, same thing happened to me, your insurance company will represent you. In my case, the insurance company represented me and notified me they were not going to settle (and that I would be personally sued) because the opposing party was demanding my insurance policy limits without providing any proof to back up their claims. I've never heard of a case where the opposing party didn't offer a settlement for policy limits, before suing personally.

Once you are personally sued, the insurance company is required to hire/(pay for) a lawyer to represent you and you receive a court summons by the opposing party (just give it to the lawyer). The lawyer will automatically file paperwork with the insurance company protecting you rights, stating that anything above policy limits is the responsibility of the insurance company since the insurance company had the chance to settle for policy limits.

I saw the lawyer one time and didn't even bother finding out what they got or have to go to any hearings/court. It was an ambulance chaser lawyer for the opposing party and was barely worth acknowledging. By the way, I was personally sued for 2 million.

On a positive note, let me fill you in on standard police procedure. Police show up where there was fight after the fact -> Police didn't see what happened and evidence is limited -> Police charge EVERYBODY who was involved or who admits to striking another person no matter how justified they claim they were ->investigate available evidence, gather it together, make report to State's Attorney.

Contrary to popular belief "self-defense" and "defense of another" are not immunities from being charged. They are defense when you are being tried in court.

Just because you are charged does not mean that you will be convicted. In the next phase of the legal system, there are two "outs." The first is the State's Attorney; he or she will read over your case with the evidence gathered. If he doesn't feel there is any good proof of a crime, he will drop the charges against you ("nolle prosequi"). Sometimes the SA may even meet with you and your lawyer before deciding to do this. If they do decide to continue with the charges, you will be tried for the assault in court. You have time to mount a defense or you can take a plea bargain.
