Work Injury - Slip And Fall?
I Need Some Help With My Homework For Careers. Read This:
&Quot;I Was Working By Myself And As I Was Going Down The Stairs, I Slipped On The Stairs And Rolled Down And Hit A Concrete Wall At The Bottom. I'M No Longer Able To Ski Or Play Hockey, And Walking Or Running - I Can'T Do Much Of That Anymore.&Quot;
What Were The Rights And Responsibilities Of The Employee And The Employer?
I'M Really Stuck On This One Because It Was A Slip And Fall Injury - Not Necessarily Anyone'S Fault.
If the injury occurred at your place of work during working hours, it still requires a workers compensation claim regardless of the fact that it was a slip and fall. It could have been caused by unsafe conditions on the stairs that need to be addressed. It is the right of the employee to receive compensation for any time missed from work and it is the responsibility of the employer to pay said claim as well as address the issue that caused the fall to begin with.
What Happens To A California Commercial Driver Caught Driving Under The Influence?
My Kids Dad Was Caught With Illegal Possesion Of Illegal Substance And Under Influence Of Marijauna And Meth. He Went To Jail And Release. Ca. Dumptruck Driver.
Your kid's dad will lose his CDL for at least a year, if not longer, and that's only if it's his first offense. If it is his second, it will be three. On a first offense, most trucking companies will not hire anyone with a drug offense for one to three years after jail time and probation has been completed.
Since his CDL is his overall license, any suspension will apply to normal driving. CDL drivers are considered to be professional drivers. Therefore, the fines, suspensions, etc., are more harsh than if the person who received these charges had a regular license.
It's a shame he took this chance. CDL drivers are under such scrutiny with the DOT, that his future in over-the-road transportation isn't looking too bright. I wish I could have given you happier news, but this is the reality of professional driving and he should have never put the public, his family, and himself at risk by using in the first place. Good luck to you...Annie
Should We Get Legal Representation For The Foreclosure Of Our Home?
We Fell Behind On Our Payments As Our Mortgage Co. Convinced Us It Would Be Better To Put Our Taxes Into Our Payment(We Were Paying Another Company Separately For Back Taxes). Well, They Lied. Our Payment Went From $1100 Per Month To $2300. Needless To Say, We Struggled. So In May They Offered For Us To Do A Loan Modification To See If They Could Lower Our Payments And Put The Past Due Payments In Arrears. After We Sent The Papers Within Their Time Frame, They Call Us 3 Months Later And Say They "Lost" Our Papers With Socials And Personal Info Mind You, And Could We Please Send Them Again. We Were Very Upset But Nonetheless Sent Them Again Certified. They Told Us It Could Take Up To 4-6 Months To Get An Answer. Well, A Month Has Gone By And We Just Received Certified Papers From Attornies Representing Our Mortgage Company Saying They Will Sell Our House At An Auction In One Month If We Don't Pay All The Arrears. Now Where They Lying When They Said We Could Possibly Do A Loan Modification? We Called Our Contact And He Said He Had To Go To A Meeting - He'd Call Back In 30 Minutes -Well, We Haven't Heard From Him Yet. He Apparently Was Transferred To A Different Department. This Is A Huge Mortgage Company That Has More Than 50% Of It's Properties In Foreclosure. Should We Get An Attorney?
Either an attorney or the moving company. I doubt that the attorney will do you any good at this point. And he will cost you $1,000 just to file papers. Is that what you want?
I hate to be the first to tell you this but I think it is time to move and mail back the keys.
Where Do You Stand On Intellectual Property Laws?
When It Comes To Intellectual Property, I'M Practically A Marxist. Inventors Of The World Unite!
People use intellectual property laws to extort money. If I create something and try to sell it, I find that there are people who have patents with no intention of creating a product. They just wait for someone to create something similar to the patent, and then use the patent to extort money.
Service Dog Laws In Colorado?
So, I'M Wanting To Move Out On My Own In The Next Couple Of Years. And A Friend Has A Service Dog For Her Mental Condition. I Just Read Some Of The Laws Here In Colorado For Such, And Not Finding Anywhere If I Will Possibly Get Sued Or In Trouble For Denying My Friend'S Service Dog Access Into My Place Of Residence. Is That Allowed? Will I Get In Trouble If The Law Finds Out I'Ve Been Denying Her Dog Into My Home?
It States In A Couple Of Places For An Individual With The Service Animal, Going Into A Place Of Rent. But Not For The Individual On The Other End Of The Debate. Basically, My Question Is: It Against The Law For Somebody In A Residential Home To Deny A Service Dog Access Into Said Home?
This isn't state law but federal law. Note toward bottom a owner of a private home can deny service dog on their property. Not sure why you would deny a friend but you are within your legal rights to deny at home. Add - makes more sense since you have allergies & one of the reasons why it is up to the individual owner to chose whether or not to allow a service dog. Just ask friend not to bring dog over due to your allergies.
Though service animals of all kinds can legally accompany their disabled handler almost anywhere the handler goes, they can be excluded from areas where their presence would constitute either a fundamental alteration of goods and services available for all or a direct threat to safety. Examples where a service animal might be excluded include:
-Sterile rooms, such as operating rooms, some areas of emergency rooms/departments, some ICU rooms, some ambulances, some delivery rooms (on a case-by-case basis)
-Clean rooms where microchips are manufactured
-Places where food is prepared (though they cannot generally be excluded from dining areas where food is present) (by order of most health departments)
-Open air zoological exhibits, such as open air aviaries (at the zoo's discretion)
-Churches (at the church's discretion)
-Native American Tribal Council Chambers (at the council's discretion)
-Federal Courts (at the judge's discretion)
-Jail or prison cells (at the discretion of the facility director)
-Private clubs (at the club's discretion)
-Private homes (at the home owner's discretion)
So far, this discussion is centered entirely on laws of access in the United States of America. Other countries will have their own laws in place regarding the access rights of individuals accompanied by a service animal.
