Grandparents do not have inherent rights to see their grandchildren. However, there are some situations in which a grandparent will be able to exert visitation or custody rights when the parents are incompetent. However, if you husband were found to be incompetent (which doesn't sound like will hapen) your children will not be removed from his custody unless a court orders that be done and, in that event, you would be given full custody and could still preclude the grandmother from seing your children in all but the most exceptional cases. In my state (California) the grandmother must actually prove that there is a significant bodn already developed between her and the grandchildren and even having custody of the child for several months didn't rise to that level in one case I know of. Ultimately, I believe you have nothing to worry about. Typically CPS will hear her case and do nothing; at most, they will open a file on it and drop it after investigation if there is no evidence to substantiate any hardship or danger to the child. Keep in mind that a "best interests of the child" standard will be used and there is generally a presumption that staying with the married parents is in the child's best interest.

Well, this is a crazily hypothetical question. I would go with door #1 and do criminal defense cases until I got enough money to try choice number 4 with the pro bono office.
