Should I Contact A Real Estate Attorney?
I Was In The Process Of Getting A Property Through Hud. My Lender Made A Typographical Error In My Name (Sarah Instead Of Sara) On The Pre-Approval Letter. Hud Contacted My Broker On Friday And Told Us That We Needed It Changed Within 24 Hours, Or Else The Deal Was Dead. Problem Was That My Lender At Wells Fargo Was On Vacation, And Wouldn'T Return Until The Following Monday. No One At The Office Could Change My Name, But Were Able To Make The Other Changes That Hud Had Asked For (Signature Location, Etc...). My Broker Was Contacted On Monday, And They Cancelled The Deal And Returned My Earnest Money! I Don'T Understand How This Is Legal? It Wasn'T An Error On My Part, And Yet I Was Denied A Property. This Is A Special Circumstance However, I Am A Teacher, And Was Offered A Property Under The Good Neighbor Next Door Program. This Program Gives Me 50% Off The Purchase Price Of Certain Homes In My Area. I'M Concerned That This Was Just There Way Of Not Letting Me Get The Discount And Trying To Get Me To Buy It At Full Cost. I Submitted My Offer On Time, And It Was Accepted Immediately. I Need Advice! Should I Contact An Attorney That Specializes In Real Estate? Or Should I Just File A Formal Complaint Against Hud? Or Both? Thanks In Advance For Any Insight And/Or Advice!

Yes, painful as it is, you need one of the most revolting practitioners around - a real estate lawyer with HUD experience. It's worth the money. Hurry b/c there is still time to apply pressure before initiating lawsuit for lost oppty. It is ludicrous to lose a property b/c of a facial error so easily corrected.

International Child Custody Lawyers? Please Read!?
My Friends Husband Left Her And Took Their Son Across Seas To Jordan Without Her Knowledge, They Are Now Divorced, The Ex-Husband Left The Child With His Family In Jordan And Took Off To Chicago To Live. My Friend Desperately Wants Her Son Back But Doesn'T Know Where To Start.. Can Anyone Help ? I Would Greatly Appreciate Any Advice. Thank You!

(This section is not the best venue for answers on this topic.)
Your friend should consult with local lawyers to find experts in this difficult field. I have read of cases where the mother chose to have someone go to Jordan and extricate the child. If the father himself is physically in the U.S. (as you stated), the first thing a decent lawyer should do is ensure that he stays local and is not allowed to travel abroad ever again until the child is returned to his mother's custody.

"If a Jordanian parent chooses to remain in Jordan or leave a child behind in Jordan, the U.S. Embassy cannot force either the parent or the Jordanian Government to return the child to the United States...."

Anybody Know Anything About Divorce Law?
Lawyer Got Senile And Gave Up At The Last Court Date Closed His Office And Retired After I Paid Him 30000.Im Divorced And Dont Have A Decree Yet Due To Him Quitting

You might try contacting his family if he truly did close because he was senile. They may be willing to give you a partial refund. If you did get the divorce accomplished you may not be entitled to a refund if the only thing he didn't do was send you a copy of the judgment. That can be obtained from the clerk's office very easily and would not be grounds for a refund. So really it depends on the specifics of the situation. If you feel he did not complete the services you paid for you should contact an attorney and he/she can help you make a demand, file a bar complaint and file suit if necissary. You can contact the CT bar association for a referral to a local attorney and they may even be able to make some other suggestions for you. They can be reached at www.ctbar.org, and the lawyer referral page is http://www.ctbar.org/article/articleview/291 and their phone number is (860) 223-4400. Good luck to you; I am sorry you are now having to deal with more difficulty on top of having to deal with the divorce. That is a lot to be going through so try to do something nice for yourself to help relax you, you deserve it.

Restraint Of Trade And Legal Advice?
If A People Signs A Document That Includes A Restraint Of Trade Clause Without Getting Legal Consultation, Is There Anything They Can Legally Argue?

Whether a legal consultation existed or not is immaterial. A restraint of trade is simply some kind of agreed provision that is designed to restrain another's trade. To be a valid restraint of trade in the first place, both parties must have provided valuable consideration for their agreement to be enforceable.
According to Section 27 of the Indian Contract Act, 1872,
Every agreement by which anyone is restrained from exercising a lawful profession, trade or business of any kind, is to that extent void.

Exception 1 : Saving of agreement not to carry on business of which good will is sold - One who sells the goodwill of a business may agree with the buyer to refrain from carrying on a similar business, within specified local limits, so long as the buyer, or any person deriving title to the goodwill from him, carries on a like business therein, provided that such limits appear to the court reasonable, regard being had to the nature of the business.

Do All Divorced Parents Have A Formal Custody Agreement?
Can'T They Just Have An Informal Cordial Agreement In Place? If They Have To Have A Formal Agreement, At What Point In The Divorce Process Does The Agreement Have To Go Into Place? Does The Child'S Age Play A Role In The Decision? Can The Parents Agree To Let The Child Leave Their Physical Custody During The Divorce Process, Like To Go To Camp Or On A Fun Trip With An Aunt, Or Something? (All Of This Is Taking Place In Virginia)

Typically when a child is involved in a divorce, they will address a formal custody agreement. This is soley based as a guidline for parents who cannot agree. If your divorce is uncontested, you have a history of being able to work together and get along, they it is highly likely the judge can allow you to have an open custody agreement, allowing you two to come to visitation agreements on your own.

The childs age does play a role - in that if 12 or older, the childs wishes concering whom they would like to live primarily with would be taken into consideration, unless 50/50 shared is awarded. - provided its in the childs best interest.

If the two of you agree for the child to go on a trip during the divorce process, that is completely fine.

The formal agreement will go into place when it has been filed. The filing of the order differs in time, depends on how you are doing the divorce, and if its contested or not.

The laws of your state could be slightly different, to get a standing answer, consult a family law attorney. Most will do a free consultation - which is perfect for asking questions like this.
