Do I Have A Case For An Ada Lawyer?
I Am A Private Citizen Living In California, And A Bonafide Disabled Person (Yes, Awarded Ssd By A Ss Judge). Early This Morning, My (Landline) Phone Rang, And It Was A Fax Machine. I Hung Up. This Repeated Apx. 5 Times, Each Time I Hung Up. After A Cup Of Coffee, Some Time Later, I Went To Use The Phone, And I Could Tell It Was An Open Line. I Hollered To Get Someone'S Attention, Hit The Plunger, But Nothing Happened. I Looked At The Number On Caller Id, And It Was An Out Of State Area Code, Not Even An Adjacent State, Not That That Is Material To The Issue. Not A Number I Knew. I Used The Reverse Phone Lookup On The Internet (Fortunately, I Have Satellite Internet, Or I'D Been Screwed) And Found The Company. I'M Trying To Make This Short Here, But My Efforts Went On For A Few More Hours, To Get Someone'S Attention (It Turned Out To Be A Company In Texas, Go Figure). I Finally Sent An Email To The Purchasing Department, And A While Later, Got An Answer. The Person Responded (Verbatim) With &Quot;...It Seems It Is Our New Data Location Has Somehow Attached The Fax Number To Your Phone Line. There Is Someone Trying To Get Hold Of The Person Who Can Go In To Where The Fax Lines Are And Disengage Your Number. We Have Confirmed That Your Line Is Being Tied Up. Please Rest Assured We Are Working On It. We Apologize For The Huge Inconvenience This Is Causing You.&Quot; First I'D Love To Know How That Is Possible - California To Texas, Wtf? Aside From That, I Am Disabled, And Live In A Canyon, Which Means I Get Crappy Cell Reception - Hence The Land Line. Now I Have No Home Phone, No Promise Of When It Will Be Fixed, But That They Are Working On It. And, I Feel Violated. I Feel They Have Violated My Rights. I Sent The Person A Response Tonight, Because Tomorrow Is Friday, And Because Texas Is A Couple Of Hours Ahead Of California, And Because I Don'T Want, And Can'T Spend The Weekend Without A Phone. For Me To Call Someone, I Have To Go Eight Miles Up The Road, And I Am In A Lot Of Pain, And On A Lot Of Pain Meds. I Advised The Company Of These Facts, And The Fact That I Wanted It Fixed Immediately - Period. Now What Do I Do, Aside From Cross My Fingers? And Do I Have A Case For An Ada Lawyer? Thanks For Any Assistance.

They or their automated system had no idea you are disabled nor did they do this because of it. They have told you they are going to fix it. Nothing to be done until they do leave you without a phone for an extended time. Then you might have a case but not now.

Best Defense In Mva Hearing For A Dui In Maryland?
I Have A Dmv Hearing In Maryland For A Dui. What Is The Best Defense To Keep My Driving Prileges? I Am Not Represented By An Attorney,What Should I Say And What Evidence Should I Bring To Keep License In Tack.

Challenging the reason for the stop is usually the most successful defense. If you can show the officer did not have a legal right to make contact with you, any evidence obtained from the stop is inadmissible.

Finding An Attorney In South Florida Regarding Copyright Issues, Nationally And Internationally?
Turns Out That I May Need To Consult An Attorney Regarding Setting Up A Working Agreement Between An Artist And Myself As Writer. The Piece Is A Visual Literary Work. As I Understand It, A Good Attorney Will Consult With Me For Free, So How Do I Go About Finding A Good Attorney In My Area Aka South Florida Aka Miami?

The main directory of attorneys is Martindale.com -- you can search by location and practice area. I suggest choosing a few likely candidates, call them up, ask if they offer a free consultation, and choose whoever you seem to get along with the best.

Is It Worth Obtaining A Disability Lawyer?
I Am Thinking Of Applying For Social Security Disability Benefits And Am Being Told To Hire An Attorney To Help. Anyone Have Experience With This And What Was Their Fee?

start the process on-line at:
http://www.ssa.gov/pgm/links_disability....

Social Security has a stringent definition of disabled it is not just a matter of having a disability but that disabilty must prevent you from doing ANY type of substinitive work. most are denied at first and also denied at the reconsideration many are approved after seeing the Administrative Judge (this is the third level of the process).
an attorney is not needed, the key is when you see the Administrative Judge what your Primary Care Provider has stated will be given the most weight but that statement must be clear that you can not do ANY work. if you have transferable job skills then it is harder to be considered disabled. age also plays a major factor in the determination if you are over 50 when you become disabled.

if you have doubts about your ability to follow through and present all the evidence needed contact an atorney to assist you.
if you decide to retain counsel they should not charge you any up front fees. they are paid out of any back payment you receive and that amount is determined by SSA with a maximum being 25% or $5300.00 (whichever is higher) of your back paid benefits. SSA actually determines the fee and writes the check to the attorney not you.

this can be a long process on average 3 years, of course some are approved at the first filing less then 7% nationwide and a little over 60% of all claims are approved (after all appeals have been completed).

EDIT:
you do receive a lump-sum for any back benefits you are due.
the lump sum is based on your monthly benefit amount times the number of back months you were due.
from the date you file, if you are approved, you can get benefits from 1 year prior to the filing date (if you were disabled that long back) once you are determined to be disabled they will also set the date that disability started.

Can You Still Hand Write A Legal Will (In Texas)?
I Have Done Some Research On The Subject But I Cannot Find Any Sources That Seem Entirely Reliable, I Know Witnesses Are Required And All The Jazz About Everyone Needing To Be Competent And Willing, As Well As Who Can And Cannot Be Witnesses, Executors, Etc. If You Can Direct Me To A Helpful, Clear-Cut Website Or A .Gov Or Tx.Us Website That Has This Information Then That Would Be Excellent. Otherwise My Questions Concern Hand Writing A Last Will And Testament, Specifically: Is It Legal And Binding If Hand Written And Signed By The Person And Witnesses? Are Lawyers Required In Any Part Of The Process? Are Executors Required For Legal Wills? Thanks For Any Help.

It is NOT true that most wills are the same in the US and the UK and you do NOT need a lawyer to review a will in Texas. You can handwrite a will and it is known as a holographic will. It will be accepted in Texas. There do not have to be any witnesses, it only has to be signed by the person who wrote it. The shortest will ever accepted was a holographic will written by a man as he realized he was dying a sudden death: "All to wife"

However, if you really want to make sure that your wishes are followed and legally binding, you really should have it prepared with an attorney. Holographic wills can create problems because there can be challenges to whether or not the person really wrote it.

Personal Injury Caps?
What Is The Reason For Having Them?

The caps are a terrible idea. They claim the reason is prevent oversized awards, but there is already a system to limit those. They claim it will save people money in insurance premium and lower costs to corporations, but the reality is the premiums stay high, corporations don't lower the prices, the money goes to the pockets of the top level management in the form of bigger bonuses. In the meantime, people are not reasonably compensated for injuries and people who injure others aren't being made to pay for what they did. (In other words, the corporations don't have to be fully responsible for making crap and selling crap products or otherwise injuring people. And insurance companies don't have to fully compensate people for their injuries.)

The idea comes from the massive insurance industry and corporations trying to get out of paying a reasonable amount for pain and suffering. They claim the caps prevent unreasonable payments, but a judge can reduce any unreasonable payment. In medical malpractice, they claim it will reduce insurance premiums for doctors, but they put on a cap in California and it had zero effect on malpractice premiums. It's a scam and they feed lies about frivolous lawsuits as the reason. Of course, when they come up with the stories, the omit key parts of it. Like the McDonald's coffee case. They omit that McDs had a lot of complaints about their coffee being too hot. They had it at 180 degrees when every other place had it 130 degrees. The difference is that at 180 it takes 2-7 seconds or less to cause major burns and at 130, it's 3 minutes. They also act the woman was the driver, but she wasn't. The car also was not in motion at the time. There is no reason to have it above 130. The jury did find that the woman was 20% responsible. By the way, she offered to settle for 20K and McDs refused.

The upshot is that people will not be able to get a fair compensation. Imagine a five year old hit by a car. Major injuries and will be in pain for the rest of their life. If you put a cap of 250K (California's cap on malpractice and a common proposal) on pain and suffering, that means that poor kid will only get $3500 a year, or $10 a day compensation for being in constant significant pain for the rest if it's life.

The upshot is, it just means more money in the hands of the insurance companies and corporations. The insurance industry does NOT lower it's premiums. The corporations don't lower their prices. They just put the money in the pockets of the CEOs while victims have to suffer without reasonable compensation.

People talk about greedy trial lawyers, but they ignore the fact that there are greedy trial lawyers working for insurance and corporations.

People claim juries hand out ridiculous awards, but that's a lie. When you know all of the facts of the case, rather than the insurance/corporate spin, then you find out the award is not unreasonable. Any losing attorney can petition the judge to lower the award if it is unreasonable and that has happened in a lot of the cases (including the McD case). But the insurance/corporate spin machines leave that information out, so people don't hear the truth. They also lie about the facts of the case.
